RépondreSupprimerSalut les gens.
RépondreSupprimerSi vous avez besoin d'un premier conseil, je suis juriste avec un peu de background en propriété intellectuelle.
Mon adresse devra être trouvable avec mon compte je pense.
Courage.
This is total crap.
RépondreSupprimerExcept, if you read it, it really isn't, these similarities being a co-incidence is really doubtful
SupprimerYou got this by E-MAIL ?
RépondreSupprimerSince when do legal notices get send by e-mail ?
I can send you everything you want by e-mail. A certificate that I am the king of the world and own everything? You can have it.
Legal notices must be send by registered mail. You should not confirm to them, you received it (if by email).
Its a cease and disist notice, its a warning that further legal action may be taken if they don't comply with this request.
SupprimerAnd its fair enough, this is really very similar, it was the reason I wanted to buy one at Salute in fact
As a sign of Solidarity i spoofed GW a c&d right back!

(sorry for being linky, if you want it removed please feel free)
+over 9000 :D
Supprimeremail correspondence is most certainly identifiable as a legal notice, such as spoken words, otherwise it would be all too easy to avoid legal implications of concluding contracts through email. said in other way, you buy stuff from internet and get confirmation and receipts via email, which have just about the same legal strength as the above mentioned letter. i have studied law and i practice law and i do not choose side but GW has a very strong case here, unless you are blessed by a good team of lawyers.
RépondreSupprimerI might have had some sympathy regarding your situation until I read the statement on intellectual property posted in your online store.
RépondreSupprimerIn the event I sculpt a "Saurian Assassin" or "Crunt's Fantome" should I expect notification from your solicitor as well? Hypocrisy is a powerful drug.
Really, you guys went a little too close to their design. I'm surprised they didn't get you for your autocannon sculpt:

Chapterhouse had the same problem. They were fans making fan things, and when they became a business they thought they could still act like fans. When you go from being fans to a business like this you have to stop producing fan work, and concentrate on originals. Sorry to sound harsh, but this is where it gets you.
Cover yourself now and take down anything that even remotely looks like GW stuff. You guys have excellent sculptors and artists. Go all the way and make your own IP that doesn't look like anyone else.
You do good work and have a lot of potential. Don't fuck it up.
It is a shame because GW will most likely never release Loxatl themselves - but it is legally sound and I do understand that they have to go after every IP infringement they are aware of because otherwise they might lose legal protection for their designs.
RépondreSupprimerAnd to be honest: Blight Wheel played with fire when they choose to get so close to the artwork, and they got burned. That's how live works most of the time.
But do you know what is really pissing me off?
RépondreSupprimerThat GW is turning a blind eye on Victoria Miniatures because she is a former employee. I mean, I don't want them to go after them, but shouldn't they?
That's eff-ing double standards.
You can't tolerate it in one case and send a C&D in others...
Actually with Victoria miniatures there isn't anything there to scream GW property. Just multi-part kits of normal human soldiers that could really be used for a lot of 28/30mm games.
